Uzbekistan to introduce a new procedure for checking activities of entrepreneurs

In accordance with the presidential decree, “Single State Control” information system has been launched, which allows coordination of the processes of checking the activities of business entities and ensuring their openness by the representative for protecting the rights and legal interests of business entities, state control functions, maintaining electronic registers of officials with the right to check the activities of business entities and mandatory requirements.

It is determined that from November 1, 2022, the regulatory authorities will carry out the following activities:

•  all inspections conducted in the activities of business entities are registered in the “Single State Control” information system. In this case, it is illegal to carry out inspections of business entities that are not registered in this system;
•  information on the results of inspections and preventive measures in the activities of business entities will be entered into the “Single State Control” information system within three days from the date of completion of the inspection or preventive measures.

Such a procedure is established, according to which:

a) supervisory bodies:

•  will notify the business entity at least 10 working days in advance of the start of inspections based on the results of the “risk analysis” system;
•  the business entity does not have the right to conduct a re-inspection on the subject and object of the previously audited activity period and to demand the documents previously submitted by the business entity;
•  will organize seminars, public discussions, media appearances, “open day” events, provide handouts and manuals, send recommendations and messages. Preventive measures for business entities will be carried out on the basis of plans-graphs agreed with the representative for the protection of the rights of entrepreneurs, without interfering in the financial and economic activities of business entities;

b) business entities have the right not to allow officials of supervisory bodies to enter their territory for inspection in the following cases:

•  when the inspection order is not issued in the established order;
•  when the inspection is not agreed with the representative for protecting entrepreneurs’ rights in the prescribed manner or when he is not notified;
•  in the absence of a special certificate giving the right to inspect the activities of business entities;
•  when they refuse to enter information in the inspection register;

c) from January 1, 2023, the supervisory bodies will be prohibited from conducting inspections in the activities of business entities for functions that are not included in the register of state control functions in the “Single State Control” information system.

The Ministry of Justice, together with the representative for protecting the rights of entrepreneurs, the Chamber of Commerce and Industry and regulatory bodies, will submit proposals to the Council of the Strategic Reforms Agency to reduce state control functions and inspections by November 1, 2022.
