Fatal road accidents to be classified as serious a crime in Uzbekistan

The draft law “On approval of the Criminal Code of Uzbekistan” (in a new edition) has been submitted for discussion, Norma writes.

A number of changes are proposed, aimed at eliminating the norms that allow for the occurrence of cases or the establishment of responsibility for actions, the level and nature of public danger of which do not correspond to the principles of criminal law.
 
The draft of the Criminal Code in the new edition consists of 26 chapters and 395 articles. It proposes to fix a number of major items.
 
Crimes committed through negligence, for which punishment is imprisonment for more than 5 years (in the current version, these crimes are classified as less serious) are also classified as serious crimes.
 
In particular, it is envisaged to transfer to the category of grave crimes the crimes committed through negligence, resulting in death and other grave consequences. The current practice of treating crimes such as traffic violations or the use of vehicles that resulted in the death of people as a less serious crime does not comply with the principle of justice.

To determine the type and amount of punishment, based on the classification of crimes, it is proposed to establish a fine of up to 200 BCAs for crimes that do not pose a great public danger, up to 400 BCAs – for less serious crimes, up to 600 BCAs – for serious crimes.

In this case, the convicted person is exempted from paying the remainder of the fine, if 2/3 of the fine imposed by the court is paid within 3 months.
 
The terms, associated with human factors, have been excluded from the criminal law. Removal of these terms leads to a rejection of the practice of qualifying an act as a crime based on the subjective opinion of the investigative and judicial authorities.
 
The system of penalties and mechanisms for their imposition has been revised, outdated forms and types of punishments that do not meet modern requirements have been removed. In particular, a clear criterion has been established and certain restrictions have been imposed on the rules for assigning a lighter punishment.

Correctional labor has also been excluded from the penitentiary system and replaced with a suspended sentence. Unlike correctional labor, punishment in the form of a deduction from wages is imposed only if the convicted person has a job.
