A pre-court dispute resolution commission has been established under the ministry. This commission will review urban planning-related documents based on appeals from legal entities and individuals. It has the authority to annul illegal or non-compliant documents. Previously, this process was carried out through the courts, which was time-consuming. Azamat Kholmuminov, an official from the Ministry of Construction, provided details about this system to Kun.uz.
On August 12, 2024, the Cabinet of Ministers adopted a resolution titled "On the Procedure for Pre-Court Review of Disputes in the Urban Planning Sector." Based on this resolution, an interdepartmental commission for pre-court review and resolution of disputes in the urban planning sector began operations under the Ministry of Construction and Housing and Communal Services.
This commission has been granted the authority to directly review urban planning documents and make decisions. It examines the legality of various documents, such as architectural-planning assignments, decisions of regional architectural-urban planning councils, conclusions from working bodies of regional architectural-urban planning councils, and permits issued by regional inspections for registering objects for construction and installation work.
"For instance, a regional department or district construction office may have issued a permit to construct a certain object. However, this permit may not comply with urban planning legislation for various reasons—for example, it might have been issued without obtaining the consent of the local population. In such cases, the commission annuls the permit or conclusion," said Azamat Kholmuminov, head of the State Architectural Supervision Department at the Ministry of Construction.
The commission operates nationwide. If a document does not comply with the law, it is annulled by the commission's decision. If it is compliant, it is returned for implementation.
Individuals and legal entities can file complaints regarding disputes over permits and related documents in urban planning through the ministry's official website or in written or verbal form.
