Retail trade of medicines to be controlled by public

In order to increase the level of provision of the population and medical organizations with high-quality medicines and medical products, create conditions for the implementation of effective public control in the field of:

provision of medicines and medical products to patients in state inpatient medical institutions (hereinafter referred to as hospitals) of the republican level, financed through the State Health Insurance Fund, is carried out through the hospital;
provision of medicines and medical products to patients in the hospital is carried out initially in hospitals of the republican level during 2023 on a pilot basis;
starting from July 1, 2023, it is prohibited to certify medicinal products without specifying a reference price or with an excess of the specified price.

It was determined that in order to introduce public control in the retail trade of medicines, starting from May 1, 2023:

when registering in a special mobile application of the tax authorities the fiscal sign of the purchase receipt provided by pharmacies for medicines purchased by individuals by scanning using a matrix barcode (QR code), the prices of medicines are automatically compared with the retail reference prices of medicines in the information system of the Agency for Developing Pharmaceutical Industry;
in the event that, as a result of scanning using a matrix barcode (QR code), an overstatement of markups to the established retail prices of medicines is detected, a message is automatically sent to the state body specially authorized to protect consumer rights to take appropriate action;
if the price on the purchase receipt is recognized as higher than the retail reference price of the medicinal product, based on the results of an audit conducted on the basis of this information, a fine is collected from the offender in the prescribed manner.

At the same time, failure to indicate in the purchase receipt the full amount of purchased medicines and medical products is recognized as a violation of the legislation on the rules of trade or the provision of services.
