President can suspend operation of regulations during a state of emergency
The President signed the corresponding amendments to the legislation.
In connection with the adoption of the constitutional law “On the state of emergency”, the head of state signed the law “On amendments and additions to certain legislative acts”.
Now according to the changes and additions:
• elections to local Councils of People’s Deputies will not be held during the entire period of the state of emergency in those regions of Uzbekistan where it has been introduced. A corresponding change has been made to Article 16 of the Law “On local self-government”;
• a presidential decree on the introduction of a state of emergency may provide for the complete or partial suspension of the powers of local self-government bodies and citizens’ gatherings during the period of the state of emergency in the territory where the state of emergency has been introduced. The above-mentioned law and the Law “On citizens’ self-government bodies” were supplemented by Articles 25-4 and 10-1;
• elections will not be held during the entire period of the state of emergency in the entire territory or in certain parts of Uzbekistan. Elections of chairmen (aksakals) of citizens’ gatherings will also not be held. Appropriate changes were made to the Electoral Code and the Law “On elections of the chairman (aksakal) of citizens’ gatherings”;
• the application of decrees and resolutions of the President, resolutions of the Cabinet of Ministers, orders and decisions of ministries, state committees and departments, as well as decisions of local governments in the territory where a state of emergency has been declared, in case of conflict with the Presidential Decree on the introduction of a state of emergency, may be suspended for the period of its validity. An addition has been made to Article 45 of the Law “On regulatory legal acts”.
