System of concessions for administrative fines imposed by courts still inoperative

In accordance with the relevant law, from May 1, 2023, the amount of the discount for paying administrative fines within 15 days has been increased. If the offender voluntarily pays 50% of the fine amount within 15 days or 70% within 30 days, he will be released from paying the rest of the fine. This procedure is intended to be applied to fines based on a court decision.

However, despite the fact that more than 1 month has passed since then, it has become known that the system of concessions for administrative fines according to court decisions has not yet started.

Earlier, it was reported that public activist, former imam Shavkat Khasan was charged with illegal preparation and distribution of religious content, envisaged in Article 184-2 of the Administrative Responsibility Code. He was fined 20 BCAs (6.6 million soums) for this action.

The former imam wrote that he wanted to use the preferential system to pay the fine, but it was not possible. He claimed that he was not given a receipt to pay the fine.

“The videos I release on the topic of family were found to be material of religious content. I was found guilty, because I did not receive the expert opinion of the Committee on Religious Affairs. The online trial was held on May 23. The judge imposed a fine of 6 million soums. A few days later, I went to the Shaykhantakhur district court on criminal proceedings and received the court decision. But no receipt was issued for payment of fine. They gave us a phone number and told us to call the next day and ask.

I called the number shown several times. Allegedly, it is invisible in the database. Tomorrow will be 14 days since the trial has passed. If it is paid within 15 days, there will be a 50% discount and I could pay a fine of 3 million soums instead of 6 million. But I am unable to pay the fine within these 15 days. It is not appearing in the database,” Shavkat Khasan said.

Tursunali Akbarov, press secretary of the Supreme Council of Judges, told Kun.uz, referring to the press service of the Tashkent city court, that this is a problem related to the MIA integration, and experts are dealing with it now.
